These Terms of Service ("Terms") govern your use of www.thenewways.eu (the "Site"), operated by The New Ways / Dysfunct Records ("we," "us," "our"), based at KMS 149, Berlin, Germany 12043. By browsing the Site, purchasing merchandise, or accessing digital content, you agree to these Terms.

Who we are

The Site is operated by The New Ways, an artist and label project releasing music (e.g. the "The Testament" EP via Dysfunct Records) and selling related merchandise such as apparel and accessories. Products and services

The Site offers digital music releases, vinyl records, and physical merchandise (hoodies, tote bags, and similar items), each with specific material composition, traceability, and compliance details listed on individual product pages. Product descriptions, including sizing notes (for example, hoodies "run small"), are provided in good faith, but we do not guarantee that colors, materials, or fit will be free of minor variation.

Age restrictions

Certain products on this Site, including apparel items, are marked "for adults" and are not intended for sale to minors. By purchasing such items, you confirm that you meet the applicable age requirement in your jurisdiction.

Orders and payment

When you place an order, you agree to provide accurate and complete billing, shipping, and payment information. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or product unavailability.

Right of withdrawal (EU consumers)

If you are a consumer residing in the EU, you have the right to withdraw from your purchase within 14 calendar days of receiving your goods, without giving any reason, in accordance with the EU Consumer Rights Directive. To exercise this right, you must inform us in writing (for example, by email) before the withdrawal period expires; we will refund the purchase price, including standard delivery costs, within 14 days of being informed of your decision, though we may withhold reimbursement until the goods are returned.

You are responsible for the direct cost of returning goods unless otherwise stated, and the right of withdrawal does not generally apply to customized, personalized, or digital content supplied immediately with your consent (such as instantly downloadable music). As required under recent EU rules, a "withdrawal" function is available so you can exercise this right directly through the Site where applicable.

Product safety and compliance (GPSR)

In compliance with the EU General Product Safety Regulation, we ensure that consumer products offered on this Site are safe and meet applicable EU standards, including flammability, lead, cadmium, bisphenol, and phthalate requirements where relevant. Each product listing includes manufacturer/responsible person contact details, product identification, traceability information, and any applicable warnings, as required by Article 19 of the GPSR.

Intellectual property

All music, artwork, branding, photographs, and written content on this Site — including releases such as "The Testament" and "Inconsequential" — are the property of The New Ways / Dysfunct Records or their licensors and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from this content without prior written permission.

Digital content and streaming links

Digital releases, press kits, and related media (such as the Digital Press Kit for The Testament EP) are provided for personal, non-commercial use or for legitimate press and promotional purposes only, unless otherwise agreed with our PR team. Any commercial use, including sampling, remixing, or redistribution, requires explicit written consent.

Shipping and delivery

Merchandise is fulfilled from various locations depending on the product (for example, weaving and manufacturing in Pakistan for apparel, or knitting and dyeing in China with manufacturing in Latvia for tote bags), and delivery times may vary accordingly. We are not liable for delays caused by customs, carriers, or events beyond our reasonable control.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Site or products purchased through it, except where such liability cannot be excluded under EU consumer protection law. Nothing in these Terms limits your statutory rights as a consumer under EU or German law.

Prohibited use

You agree not to use the Site for unlawful purposes, to infringe intellectual property rights, to upload harmful code, or to interfere with the Site's normal operation. We reserve the right to suspend or terminate access for users who violate these Terms.

Governing law and disputes

These Terms are governed by German law, without prejudice to any mandatory consumer protection rules of your country of residence if you are an EU consumer. Any disputes will first be addressed through good-faith negotiation; EU consumers may also use the European Commission's Online Dispute Resolution platform.

Changes to these Terms

We may update these Terms from time to time to reflect changes in our products, services, or legal obligations, and will post the updated version on this page with a new "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
